RATING AND REVIEW PROMOTION
THE FOLLOWING SWEEPSTAKES IS FOR PLAY IN THE UNITED STATES ONLY AND SHALL BE CONSTRUED AND EVALUATED ACCORDING TO UNITED STATES LAW. DO NOT ENTER THIS SWEEPSTAKES IF YOU ARE NOT LOCATED IN THE UNITED STATES AT THE TIME OF ENTRY.
1) ELIGIBLE PARTICIPANTS:
NO PURCHASE NECESSARY TO ENTER OR WIN; MAKING A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING. YOU MUST BE AT LEAST 18 YEARS OF AGE TO PARTICIPATE IN THIS SWEEPSTAKES. ALL ENTRANTS MUST HAVE A VALID E-MAIL ADDRESS. ALL FEDERAL, STATE, LOCAL, AND MUNICIPAL LAWS AND REGULATIONS APPLY. VOID WHERE PROHIBITED.
This Promotion is open to all legal United States residents at least 18 years old at time of entry. Employees and directors of DSW, its subsidiaries, affiliates, agencies and their immediate families (parent, child, siblings, spouse) and members of the same household (whether related or not) of such persons (collectively, "Sponsor Entities"), are not eligible to enter.
By entry into this Promotion, winners agree to be bound by these Official Rules and consent to the use of her name, city and state of residence, likeness and/or photograph for promotional purposes online and offline without additional compensation, unless prohibited by law.
2) HOW TO ENTER:
The DSW Website Rating and Review Sweepstakes ("Promotion") begins at 10:00 AM (EST) on Monday, August 31, 2009 and ends at 11:59 PM (EST) on Sunday. October 11, 2009 ("Entry Period"). The Promotion will provide Eligible Participants (as defined below) the opportunity to win a DSW gift card ("Prize"), in connection with submitting a complete product review online on dsw.com between August 31, 2009 and October 11, 2009.
You may enter the Sweepstakes either by completing a product review on-line at dsw.com or by U.S. Mail. Sweepstakes entry via on-line at dsw.com requires participant to create a free user account on dsw.com. One valid and complete product review equals one contest entry. Multiple reviews of the same product are not valid. "SPAM" or fraudulent reviews will not be posted and all entries from said user will be void.
To enter by U.S. Mail, hand print your name, city, state, zip, email address, and review of experience using the dsw.com website (40 words or less) on a 3X5 index card, insert in an envelope, affix postage and mail to DSW Marketing, Rating and Review Promotion, 810 DSW Drive, Columbus, Ohio 43219. Mail-In Entries must be postmarked by September 28, 2009 and received no later than October 25, 2009.
The winner(s) will be determined from among all eligible entries received via dsw.com and Mail-in. This contest is sponsored by DSW, Inc. DSW and its agencies are not responsible for lost, damaged, misdirected, illegible or incomplete registrations, reviews, or entries. No other method of entry will be accepted. Incomplete entries are void. The winner(s) will be determined from among all eligible entries received during the Entry Period. All entries become the property of DSW ("Sponsor"). This information ("Entries") will be used by DSW and affiliate companies.
3) PRIZES:
FIVE (5) PRIZE WINNERS: The Winners of the Rating and Review promotion will receive one (1) $100 DSW Gift Card redeemable for merchandise at any DSW Store or on-line at dsw.com. The approximate retail value (ARV) for each prize is $100.
There is no expiration date on the gift card. Card can be used to purchase merchandise at any DSW Store location in the USA or via the internet at dsw.com. The card may not be exchanged for cash. If lost or stolen, this gift card cannot be replaced. Any DSW card balance remaining may be used for future purchases. Usage and redemption of the gift card is subject to the terms and conditions of the issuing entity.
4) SELECTION OF WINNERS:
Winners will be selected from all eligible Entries received in a random drawing to be conducted by Sponsor (or its designee) on or before Wednesday, October 19, 2009. Winners will be notified by email within seven (7) days of the drawing. Prizes will be awarded upon verification by Sponsor that all contest requirements have been met by the winners. Each Prize must be accepted as awarded and no substitution, transfer, conversion or assignment of Prizes will be allowed, unless at the discretion of the Sponsor which may substitute a Prize of comparable or greater value. No correspondence will be entered into except with selected Entrants at the email address listed on the entry. The winner will have seven (7) calendar days from notification to accept the Prize by email, and will be instructed whom to contact at that time. DSW is not responsible for and shall not be liable for late, lost, misdirected, or unsuccessful efforts to notify the winner.
If a selected Entrant cannot be contacted within the allotted time Sponsor reserves the right to void that entry and select another eligible Entrant for that Prize. If a selected Entrant(s) fails to contact the Sponsor within seven (7) days the Sponsor reserves the right to void that entry and select another eligible Entrant for that Prize.
By entering this Sweepstakes the contestant (i) confirms compliance with these Contest Rules and Regulations, (ii) releases and forever discharges the Sponsor, its affiliates and subsidiaries and their respective advertising and promotional agencies from all claims, demands, damages, actions and causes of action arising or to arise by reason of the acceptance or use of the Prize, and (iii) gives permission to the Sponsor, at their option, to publish or otherwise use the Entrant's name, address, photograph, voice and comments, without compensation, in any publicity carried out by the Sponsor or their respective advertising agencies. All Prizes will be delivered via certified mail by the Sponsor to the official winners within 10 (ten) days after notification and acceptance to the Prize Winner.
Sponsor reserves the right, in its sole discretion, to cancel or suspend this sweepstakes should viruses, bugs, or other causes beyond the control of DSW corrupt the administration, security or proper administration of sweepstakes. DSW is not responsible for computer system, hardware, software or program malfunction or other errors, failures, delayed computer transmissions or network connections that are human or technical in nature. In the event of a dispute regarding the identity of the person submitting an electronic entry, the entry will be deemed to be submitted by the person in whose name the e-mail account is registered. If prize notification e-mail or prize returned as undeliverable, the prize will be awarded to an alternate winner. Limit one prize per person/address.
Prize winners grants to Sponsor the right to use his/her name and likeness in advertising and promotion without further compensation or permission, except where prohibited by law. Please view our privacy policy at dsw.com to see how we use personal information collected in connection with this contest. Sponsor's decisions are final and binding with regard to this sweepstakes. Odds of winning the prize will be determined by the number of eligible entries received.
5) GENERAL CONDITIONS:
By entering, entrants acknowledge compliance with these Official Rules including all eligibility requirements. Neither the Sponsor nor Sponsor Entities, any telephone network or internet service provider, are responsible for incorrect or inaccurate transcription of entry information, or for any human error, technical malfunctions, omission, interruption, deletion, defect, line failures of any telephone network, computer equipment, software, inability to access any Web site or online service, or any other error or malfunction, or late, lost, illegible or misdirected entries. Entries that have been tampered with or altered are void. No copies, facsimiles, or reproductions of entries will be accepted.
United States law shall apply exclusively to the Sweepstakes and that any dispute with respect to the Sweepstakes shall be resolved in either the federal or state courts located in the State of Ohio. If, for any reason, the Sweepstakes is not capable of running as originally planned (such as virus, bugs, tampering or other causes beyond the control of the Promoter, which, in the sole opinion of Promoter, corrupt or impair the administration, security, fairness or proper play of the Sweepstakes), the Promoter reserves the right at its sole discretion to suspend, modify or terminate the Sweepstakes, at which time, Promoter will conduct a random drawing from among all eligible entries received at the time of the Sweepstakes termination.
CAUTION: ANY ATTEMPT TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.
